土地分配結果異議

土地所有權人對土地分配結果異議處理

公辦重劃:

(1)土地所有權人對土地分配結果有異議時,得於土地分配公告30日之期間內向主管機關以書面提出異議。未提出異議或逾期提出者,其分配結果於公告期滿時確定。

(2)主管機關對於土地所有權人提出之異議案件,得先予查處。其經查處結果如仍有異議者或未經查處之異議案件,應以合議制方式予以調處;調處不成者,由主管機關擬具處理意見,連同調處紀錄函報上級主管機關裁決之。

(3)分別共有土地調整分配為單獨所有者,共有人如提出異議,主管機關得不予調處,仍分配為共有。

自辦重劃:

理事會經研擬重劃分配結果草案後,應檢具相關圖冊提交會員大會通過,並公告公開閱覽30日,公告期間土地所有權人對土地分配結果有異議時,理事會應予協調處理,並將協調處理結果送會員大會追認;協調不成時,異議人得依該重劃會章程所定期限訴請司法機關裁判。
