所有權人死亡未辦竣繼承登記，其全體繼承人領取時，應依民法相關規定製作繼承系統表，並檢具完備之繼承資料會同向縣市政府(地政局)提出申請，經審核無誤後，即可核發補償費予繼承人；如繼承人無法全體會同時，可參照土地徵收條例第25條規定，檢附完備之繼承資料由部分繼承人按其應繼分領取補償費。
