辦理市地重劃地區禁止土地移轉或興建房屋重劃地區範圍確定後，依照平均地權條例第59條規定，主管機關得視實際需要報經內政部核定，分別或同時公告禁止或限制該地區之土地移轉、分割、設定負擔及建築改良物之新建、增建、改建或重建及採取土石或變更地形，禁止或限制之期間，不得超過1年6個月。
如在公告禁建前已依法核發建造執照且正在施工中的建築物，經審核不妨礙重劃工程及土地交換分配者，得准予依原核發建造執照繼續施工；但經審核有妨礙重劃工程或土地交換分配者，將通知其限期改善或停工。
